To exchange data and samples for research projects between institutions, a data transfer and use agreement (DTUA) and/or a material transfer agreement (MTA) is required. As part of a national harmonization effort, SPHN and SBP have developed common models for the two documents, in collaboration with Swiss universities, domain institutions and university hospitals. Details can be found in today`s newsletter. SBP Material Transfer Agreement (MTA) Models provide for the transfer and use of biological materials or biological resources (i.e. biological materials and associated data) provided by a supplier to a non-profit third party wishing to use this material for research purposes. The models will be used by swiss Biobanking Platform (SBP) partners who adhere to the principles of governance of current ethical and legal requirements and comply with professional biobanking standards as set out in their biobanking regulations. Their use is limited to exchanges between academic institutions and is not suitable for exchanges between for-profit organizations. SBP and SPHN encourage their partners and all those working with biological material or data in Switzerland to adopt these models. Indeed, the same MTA and DTUA model will be used in the future by these institutes, which represents a considerable added value.

MtA and DTUA are essential regulatory requirements that define the rights, responsibilities and obligations of the parties involved (for example. B, suppliers, recipients, processors) with respect to authorized use, ownership, publications, intellectual property and liability when biological material and/or data are transferred or accessed as part of a project.
